1. Scope and Overview

This Privacy Policy describes how Stocktwits, Inc. (“Stocktwits,” “we,” “us,” or “our”) collect, use, disclose, and retain personal information when you use the Stocktwits websites, mobile applications, subscriptions, widgets, APIs, communications, and other services that link to this Privacy Policy (collectively, the “Service”).

This Privacy Policy does not govern a separate storefront, merchandise store, or other service that presents its own privacy notice or is operated by a separate merchant of record.

If you do not agree to this Privacy Policy, do not use the Service.

2. Personal Information We Collect

Information you provide directly.

  • Contact and communications information, such as your name, email address, phone number, and the contents of communications you send to us through web forms, email, social media, or support channels.
  • Registration information, such as your email address, username, password, and mobile phone number when you create an account.
  • Account, profile, and community information, such as profile fields, account settings, subscriptions, posts, replies, likes, shares, symbols, watchlists, follows, followers, direct messages, and other content or interactions associated with your account.
  • Marketing and newsletter information, such as your contact details, marketing preferences, and information about your engagement with newsletters, marketing emails, and similar communications.
  • Survey, review, testimonial, and partner-contact information if you choose to provide it to us.

Information from third parties and public sources.

  • If you contact us through a social-media page or similar third-party service, we receive the information you choose to provide and any information the third party makes available to us under its rules and settings.
  • When the VettaFi integration described in our Cookie Policy is enabled, we receive audience insights, analytics, and related segmentation information from VettaFi, including information that helps us understand whether visitors appear to belong to advisor or intermediary segments.
  • If you choose to sign in through a third-party authentication provider, such as Google or Apple, we receive the information that provider makes available to us based on your settings with that provider and the permissions you grant. Depending on the provider and your settings, this information can include your name, email address, profile image, account identifier, and authentication-related information needed to sign you in and maintain your account. We use this information to authenticate you, create or maintain your account, and support related account and security functions.

Information collected automatically.

  • Device and browser information, such as IP address, device identifiers, browser type, operating system, language settings, and general location information such as city, state, or region. Depending on the feature and technology, this can also include IP-derived geographic information, URL information (including UTM parameters), and HTTP referrer information.
  • Online activity information, such as pages or screens viewed, navigation paths, time spent, access times, links clicked, interactions with content or ads, whether you open or engage with our communications, and related engagement metrics such as time on page.
  • Information collected through cookies, web beacons, pixels, browser storage, and similar technologies, as described in our Cookie Policy. When the VettaFi integration described in our Cookie Policy is enabled, the VettaFi Pixel may collect information from your browser or device and your interactions with our site, including IP address, approximate geographic location derived from IP address, browser information, URL (including UTM parameters), HTTP referrer, and time on page. Stocktwits also discloses users’ hashed email addresses to VettaFi for matching and audience analysis in connection with Stocktwits’ direct advertising business.

3. How We Use Personal Information

  • To operate, maintain, and provide the Service, including account creation, authentication, profile management, posting, messaging, watchlists, widgets, APIs, and subscription features.
  • To communicate with you about the Service, including support, account notices, security alerts, service updates, and administrative messages.
  • To send newsletters, marketing communications, and similar content you request or that we send as permitted by law, and to measure engagement with those communications.
  • To personalize the Service, such as by remembering preferences and settings and presenting content based on your interactions with the Service.
  • To measure, troubleshoot, test, secure, improve, and develop the Service and related offerings, including analytics, performance monitoring, benchmarking, and research.
  • To display advertising; support ad measurement, attribution, audience analytics, direct advertising sales, and related audience segmentation; measure the effectiveness of marketing; and honor advertising or cookie preferences where required by law.
  • To enforce our Terms, House Rules, and other applicable terms; investigate abuse, fraud, or security incidents; protect users and the Service; and comply with legal obligations.

4. Aggregated, Deidentified, and Public-Facing Information

We create and use aggregated or deidentified information that is designed not to reasonably identify individuals. We use this information for analytics, service improvement, benchmarking, market analysis, and related lawful business purposes.

Certain parts of the Service are public by design. Depending on the feature and your settings, your username, public profile information, posts, comments, likes, follows, watchlists, and other public interactions may be visible to other users, search engines, embedded widgets, API users, partners, or the general public.

We use public content and public-facing data to support Service functionality such as public profiles, public feeds, widgets, and APIs.

5. How We Disclose Personal Information

  • Service providers that perform services for us, such as hosting, analytics, payment processing, customer support, security, and communications services, subject to appropriate contractual protections.
  • Advertising, measurement, and analytics partners in connection with the advertising, analytics, and cookie-based activities described in this Privacy Policy and our Cookie Policy.
  • VettaFi, in connection with the VettaFi Pixel and related audience analytics for Stocktwits’ direct advertising business. When the VettaFi integration described in our Cookie Policy is enabled, this can include disclosure of your hashed email address to VettaFi for matching and audience analysis, together with information collected from your browser or device and your interactions with our site, including IP address, approximate geographic location derived from IP address, browser information, URL (including UTM parameters), HTTP referrer, and time on page. Stocktwits uses the resulting audience insights and reports to support direct advertising sales, understand engagement by advisor and intermediary audiences, and enhance audience targeting for those segments.
  • Other users and the general public when you use public features of the Service.
  • Third-party services or integrations that you choose to use or access through the Service, in which case your information is also subject to that third party’s terms and privacy policy.
  • Professional advisors, corporate transaction counterparties, law enforcement, regulators, courts, and others where disclosure is reasonably necessary to enforce our rights, protect the Service or users, comply with law, or complete a business transaction.

6. Cookies, Analytics, and Advertising

We use cookies and similar technologies for authentication, security, preferences, analytics, advertising, and related purposes. Our separate Cookie Policy describes these technologies, our current cookie categories, available choice mechanisms, and certain third-party tools used in connection with the Service, including VettaFi and other third parties that support analytics, advertising, measurement, delivery, attribution, identity resolution, fraud prevention, and related service operations for the Service.

Some advertising and analytics activities that involve third-party cookies, pixels, or similar technologies - including identifier-based matching and audience analytics described in our Cookie Policy - can constitute a “sale,” “sharing,” or “targeted advertising” under certain U.S. state privacy laws. Where applicable, you can adjust your choices through our cookie-preference tool and other methods described in our Cookie Policy and Section 8 below.

7. Your Choices

  • Account information and settings. You can access or update certain account, profile, and preference settings through your account.
  • Public content and profile visibility. You can control certain profile fields and settings, but public content and public interactions can remain visible to others, be retained in backups or archives, appear in search indexes, or remain available through user reshares or public Service features.
  • Marketing communications. You can opt out of promotional emails by using the unsubscribe link in those emails. We continue to send transactional, security, support, and other non-promotional communications related to the Service.
  • Cookies and targeted advertising. You can adjust certain cookie and advertising preferences through our cookie-preference tool and, where required by law, through recognized browser-based preference signals such as Global Privacy Control.

8. U.S. State Privacy Rights

Depending on where you live, you can have rights under applicable U.S. state privacy laws, including the right to request access to, correction of, deletion of, or a copy of personal information we hold about you, and the right to opt out of sales, sharing, targeted advertising, or certain profiling, including with respect to cookie-, pixel-, and identifier-based advertising activities described in this Privacy Policy and our Cookie Policy (https://stocktwits.com/about/legal/cookie-policy).

You can submit rights requests through privacy@stocktwits.com. We take reasonable steps to verify your request and your identity before responding. You can also designate an authorized agent to act on your behalf, subject to verification requirements.

If we deny your request, you may have the right to appeal our decision by contacting us at privacy@stocktwits.com.

We honor Global Privacy Control signals for opt-out requests where required by applicable law.

9. Additional Information for California Residents

In the preceding 12 months, depending on how you use the Service, we have collected the following categories of personal information: identifiers and contact information; account credentials and profile information; user content and visual information you choose to upload; subscription, payment, and commercial information; device, log, and internet or network activity information; approximate geolocation information; and communications or support records.

We collect this information from the sources described in Section 2, use it for the purposes described in Sections 3 and 6, and disclose it to the categories of recipients described in Sections 4 and 5, including advertising-related disclosures that can involve email addresses, online activity information, and pixel- or cookie-based data as described above.

We do not knowingly sell or share the personal information of individuals under 16.

10. Additional Information for Individuals in the EEA and UK

If you are in the European Economic Area or the United Kingdom, Stocktwits is the controller of your personal information for purposes of applicable data-protection law unless otherwise stated.

Our legal bases for processing personal information include performance of a contract with you, our legitimate interests in operating, securing, improving, and communicating about the Service, your consent where required by law, and compliance with legal obligations.

Subject to applicable law, you can have rights to request access to, correction of, deletion of, restriction of, or objection to processing of your personal information, and the right to data portability. Where we rely on consent, you can withdraw that consent at any time without affecting processing before the withdrawal.

You can lodge a complaint with your local supervisory authority if you believe our processing violates applicable law.

11. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Service, maintain business records, resolve disputes, enforce agreements, comply with legal obligations, and preserve security, backup, and audit information.

Retention periods vary based on the type of information, the context in which it was collected, the nature of the Service, user expectations, applicable law, and our legitimate interests.

12. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No security measure is perfect, and we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your credentials and for using unique passwords and other available account-protection tools.

13. International Transfers

We are based in the United States, and we and our service providers can process personal information in the United States and other countries where privacy laws differ from those in your jurisdiction.

When required by law, we use appropriate safeguards for international transfers, such as contractual protections and other lawful transfer mechanisms.

14. Children

The Service is not directed to children under 18, and we do not knowingly collect personal information from children under 18. If you believe a child has provided us with personal information in violation of this Privacy Policy, contact us so that we can investigate and take appropriate action.

15. Changes to This Privacy Policy

We revise this Privacy Policy from time to time. If we make material changes, we will post the updated version, update the effective date, and provide any additional notice required by law.
